Subscription Agreement

1. Acceptance and Modification of Service Terms
This Agreement is an agreement between PhotoArt members (hereinafter referred to as "members") and PhotoArt APP (hereinafter referred to as "PhotoArt") regarding the use of the automatic renewal entrusted deduction service provided by PhotoArt (hereinafter referred to as "this Service") by members. This Agreement describes the rights and obligations between PhotoArt and members regarding the use of this Service and related aspects. "Member" refers to an individual or a single entity that enjoys the member service provided by PhotoArt. This Agreement constitutes a prerequisite for members (whether individuals or organizations) to use the Service provided by PhotoArt. Unless members accept the terms of this Agreement, they have no right to use this Service. Members' choice to use this Service will be deemed as their agreement to be bound by the terms of this Agreement.

2. Service Description
2.1 This service is launched to meet the needs of members for automatic renewal. On the premise that members have activated this service, this service is launched to avoid losses caused by members' failure to renew in time due to negligence or other reasons. Members irrevocably authorize PhotoArt to deduct the subscription fee for the next billing cycle from the balance of the member's own recharge account and the bank card bound to the member account (hereinafter collectively referred to as the "account") when the membership validity period is about to expire. The premise for the realization of this service is that the member has bound his PhotoArt member account to the above account and can successfully deduct money from his above account.
2.2 Automatic renewal specifically refers to the deduction method of PhotoArt collecting the subscription fee for the next billing cycle from the member through the above account based on the premise of 2.1. Members need to ensure that PhotoArt can successfully deduct money from the above account. Members shall bear the responsibility for the failure of renewal due to insufficient deductible balance in the above account.
2.3 When enjoying this service, members shall be bound by the PhotoArt Member Service Agreement. When members use this service, their use behavior is deemed as their agreement to the terms of service of this service and various public notices issued by PhotoArt regarding this service.
2.4 The services provided by PhotoArt to members are limited to members' use on the PhotoArt platform. Any behavior that separates the content of this service provided by PhotoArt from the PhotoArt platform by illegal means such as malicious cracking does not belong to the services agreed in this agreement. All legal consequences arising from this shall be borne by the person who committed the act, and PhotoArt will pursue the legal liability of the person who committed the act in accordance with the law.
2.5 Since membership is a virtual service, you have the right to choose not to continue to enjoy the membership service after purchasing the membership. Except for the reason that PhotoArt cannot provide membership services normally, if you cancel the purchased membership services or terminate your membership, you will not be able to obtain a refund of the fees paid for purchasing membership services or any other form of compensation.
2.6 After you become a PhotoArt member, the membership rights you can enjoy shall be subject to the membership rules published by PhotoArt. In order to provide better services to members, PhotoArt has the right to adjust all or part of the membership rights and interests based on its own business development needs. PhotoArt will notify or announce the above-mentioned member rights and interests adjustment on the corresponding member service page. You can check the latest member rules on the member rights and interests through PhotoArt. PhotoArt encourages you to regularly review this agreement and the member rules to better protect your rights and interests.
2.7 The validity period of PhotoArt membership service shall be subject to the page display period on which the member chooses and pays the corresponding membership fee. After the validity period of PhotoArt membership service expires, PhotoArt will stop providing you with membership services, and the exclusive member rights and interests will immediately expire.
2.8 The charging standards for PhotoArt membership services are determined by PhotoArt based on its own operating strategy (including the formulation of different membership types, prices, and rights and interests of different membership types, etc.), and will be displayed to you on the member service purchase page. You agree that your continued operation (including but not limited to clicking to agree to purchase, payment behavior, and continued use of membership services, etc.) shall be deemed as your knowledge and agreement to the charging standards.
2.9 After you become a member, the specific member rights or services you can actually use may differ due to the different PhotoArt software versions and operating systems you use, which may cause you inconvenience. You understand and will not pursue and exempt PhotoArt from related responsibilities. It is recommended that you try to solve the problem by upgrading the PhotoArt application or operating system version, or directly contact customer service for resolution.

3. Rights and obligations of both parties
3.1 PhotoArt is responsible for providing members with a method to inquire about the specific details of automatic renewal charges, but is not responsible for printing relevant invoices and forwarding them to members.
3.2 PhotoArt will deduct the subscription fee for the next billing cycle from the member's account on the same day, and the amount will be recorded in the member's payment record, and the validity period of the membership will be extended accordingly.
3.3 If an error occurs during the deduction process, PhotoArt and the member shall work closely together to find out the cause and each shall bear the loss caused by its own fault; if the loss is caused by unequal faults of both parties, both parties shall bear the corresponding responsibility according to the degree of fault; if both parties are jointly responsible, both parties shall share the responsibility equally.
3.4 PhotoArt may change or modify the relevant service content, rules and terms of this Agreement according to its business development or technology upgrades. Before making the above changes or modifications, PhotoArt will publicize the modified content on the relevant PhotoArt page, but has no obligation to make individual notifications separately. If the member disagrees with the modification of this Agreement, he/she may cancel the service he/she has obtained and stop using it; if the member continues to use the service provided by PhotoArt, it shall be deemed that the member has accepted all the modifications of this Agreement.
3.5 The member shall choose whether to cancel this service. If the member chooses not to cancel, it shall be deemed that the member agrees that PhotoArt will make irregular deduction attempts according to certain rules. Once the deduction is successful, PhotoArt will open the subscription service for the next billing cycle for the member.
3.6 If the price of PhotoArt subscription service is adjusted before/at the time of automatic renewal, the current effective price shall prevail.
3.7 PhotoArt does not charge any fees for members to open this service, but PhotoArt has the right to decide whether to charge for this service itself or adjust the automatic renewal cycle and fees based on business needs or market changes, and shall make public announcements to members on the relevant pages.
3.8 You acknowledge and agree that: for the selected payment channel, you have the obligation to ensure regular attention and ensure that there is sufficient balance under the account of the payment method to meet the application of this service. If the service cannot be used due to defects for the above reasons (including but not limited to: insufficient balance, insufficient balance to meet your choice of service), this application has the right to suspend your membership service without further notice.
3.9 After purchasing the membership service, users should carefully and reasonably save and use it, otherwise the user shall bear all the responsibilities arising therefrom. At the same time, PhotoArt has the right to make independent judgments in this case and may take measures such as suspending or closing the user's membership.
3.10 Users shall not obtain or purchase membership service qualifications through illegal means such as theft, exploitation of system loopholes, or on websites or other channels that illegally sell or transfer members without PhotoArt's authorization, otherwise PhotoArt has the right to cancel your membership service qualifications. The losses caused by this shall be borne by the user, and PhotoArt shall not bear any responsibility. For the above-mentioned violations by users or the use of membership services for illegal acts, PhotoArt has the right to deal with your membership account and rights and reserves the right to pursue legal liability in accordance with the law, including: 3.10.1 PhotoArt has the right to freeze and cancel your membership, and will not provide any compensation or refund any membership purchase fees. 3.10.2 Once your membership is cancelled due to the above violations, you will no longer be able to enjoy the various membership benefits and value-added services, nor enjoy the membership rights.

4. Validity period and termination of the agreement
4.1 This agreement will take effect from the time the member chooses to accept or use the service and will terminate when the member terminates the service/cancels the membership.
4.2 Members have the right to choose to terminate the service at any time in the member account settings. After the termination of the service, PhotoArt will stop providing the service to the member.
4.3 The instructions that the member has entrusted PhotoArt to automatically renew the fee before choosing to terminate the service will remain valid. PhotoArt will not refund the fees deducted based on the instructions, and the member shall bear the relevant responsibilities.
